Germany's Right of Return Residence is a statutory route for certain people who previously lived in Germany for a substantial period and then left. It is narrow, but it matters for former long-term child residents and some German-pension recipients.
The main child-resident route generally requires:
- Lawful habitual residence in Germany as a minor
- Eight years of lawful residence before departure
- Six years of school attendance in Germany
- Application after age 15 and before age 21, and within five years of departure
- Support through the applicant's own economic activity or a five-year maintenance commitment from a third party
Section 37 also says a foreigner who receives a pension from a German institution will generally be granted residence if they lawfully resided in Germany for at least eight years before departure.
