Summary
Section 5 of the Citizenship Act creates a descent-certificate route for a child born outside Trinidad and Tobago to a parent who is a T&T citizen by descent. It is a narrow route with strict timing and a generation limit.
Who qualifies
The route is strongest where you can show:
- The applicant was born outside Trinidad and Tobago.
- A parent was a T&T citizen by descent.
- The parent did not become a citizen through this same section 5 subsection.
- The application is made by a parent or guardian before the applicant reaches full age, or by the applicant within one year after reaching full age.
- The family and citizenship records can be produced.
Records to gather
Expect to gather:
- Applicant's birth certificate
- Parent-child link records
- Proof of the parent's T&T citizenship by descent
- Parent or guardian authority records if the applicant is a minor
- Consular or application forms required by the Minister
What to watch
This is not an unlimited-generation descent rule. The Act says section 5 does not apply to the child of a person who became a citizen through section 5 itself.
