Summary
The UK Returning Resident visa is for people who were previously settled in the UK and have been away long enough that their indefinite leave to remain (ILR) or settled status may have lapsed. If approved, it lets you return to the UK with your settlement restored.
This is not a new work or family visa, and it is not part of the points-based system. It is a route back to UK settlement for someone who can show they previously held settled status and still has strong UK ties.
Eligibility
You may be a fit if:
- You previously held indefinite leave to remain or settled status in the UK.
- You have been away long enough that your status may have lapsed. GOV.UK lists the lapse period as 2 continuous years for most ILR holders, 5 years for most EU Settlement Scheme settled-status holders, and 4 years for Swiss citizens and their family members with EUSS settled status.
- You can show strong ongoing ties to the UK and explain your current circumstances and why you lived abroad.
- You are not already a British or Irish citizen.
What This Route Allows
If your application is approved, you can return to the UK with indefinite leave to remain. That restores your settled status, which can later support an application for British naturalisation if you go on to meet those separate requirements.
What This Route Is Not
- A new work, study, or family visa.
- British citizenship on its own.
- A guaranteed result. The application needs evidence of strong UK ties and an explanation of your circumstances, and it is assessed on those facts.
- Necessary if you have been away for less than the relevant lapse period. In that case you may still hold your settled status and may not need this visa at all.
Next Steps
- Confirm you previously held indefinite leave to remain or settled status in the UK.
- Work out how long you have been away and compare it to the lapse period for your type of status (2 years for most ILR, 5 years for most EUSS settled status, 4 years for Swiss citizens and family with EUSS settled status).
- If you are within the lapse period, check whether you still hold your status rather than applying for this visa.
- If your status has lapsed, gather evidence of strong UK ties such as long UK residence, family ties, income, or property.
- Prepare an explanation of your current circumstances abroad and why you left the UK.
- Review the official guidance and apply for the Returning Resident visa.
