Summary
A foreign spouse or recognized partner of a Guatemalan citizen can seek permanent residence after the marriage or declared union has lasted at least one year. The relationship must be registered with RENAP. Engagement and a future wedding do not qualify. This is a residence application, not automatic Guatemalan citizenship or a waiver of other document requirements.
Eligibility
A registered relationship of at least one year
The marriage or formally declared union must be registered with RENAP. An unregistered foreign certificate does not by itself meet Article 28.
Your partner’s records
Provide RENAP’s marriage or union certificate and your Guatemalan partner’s birth certificate showing the registered relationship.
Your own records
Prepare your passport, entry and background records, and the other documents required for permanent residence. Arrange official authentication and translation of foreign documents where required.
-
Formal relationship Register the marriage or declared union Use the required RENAP civil records.
-
At least 1 year Complete the qualifying relationship period Document at least one year and the Guatemalan partner’s status.
-
Residence application Apply for permanent residence Submit the current relationship and other required personal evidence.
Engagement or an unregistered certificate alone does not qualify. Residence does not automatically grant citizenship.
What This Route Allows
The route leads directly to an application for permanent residence once the relationship and general requirements are satisfied.
What This Route Is Not
Engagement and a future wedding do not qualify. This is a residence application, not automatic Guatemalan citizenship or a waiver of other documentary requirements.
Next Steps
- Check the relationship date and RENAP registration.
- Obtain the marriage or union certificate and your partner’s updated birth record.
- Correct any missing or inconsistent records, then prepare your own application documents.
- Submit the permanent-residence application once the one-year requirement is met.
