Summary

A foreign spouse or judicially recognized de facto partner of a Portuguese citizen may acquire Portuguese nationality by declaration after the relationship has lasted more than three years. The marriage must still exist when the declaration is made; a de facto union requires a Portuguese court decision recognizing it.

For a relationship of no more than six years without a common Portuguese child, the authorities may also oppose the case for lack of an effective connection to Portugal. That connection is assessed through language, cultural, historical, civic, democratic, support, and related integration factors. After more than six years, or where the couple has a common Portuguese child, that particular connection ground does not apply, although the serious-crime, security, and sanctions grounds remain.
