Guatemala Residence with a Local Employer
At a glance
A job offer from a Guatemalan employer can support temporary worker residence for up to five years, depending on the offer and immigration’s decision. You need a detailed offer and the required guarantee from a registered Guatemalan guarantor, unless a specific government-employer exception applies.

Summary
Guatemala’s employee residence category lets an overseas worker stay for a job with a local employer. That employer supports the residence file and the separate Ministry of Labor process. Confirm both approvals before starting the job. Employment for an overseas company and self-employment follow different categories, so the identity of the actual employer matters.

Obtain the detailed local-employer offer Confirm the employer can support the immigration and labor requirements.
-
Prepare the guarantee and personal evidence Identify the required guarantor documents or applicable government-employer exception.
-
Complete both required permission processes Coordinate residence and work authorization before employment starts.
Residence and permission to work are separate. The approved period and any employer change must be tracked.
Eligibility
A real local offer
The original offer must identify the position, hours, contract period, pay, start date, and place of work. A job search or an offer from an unrelated foreign employer does not qualify for this local-employer category.
Guarantee and labor requirements
The ordinary local-employer case requires a Guatemalan guarantor with current registration evidence. A qualifying Guatemalan government body, including an autonomous or decentralized body, has a specific exception using an offer signed by its head of human resources. Confirm the correct evidence for the actual employer.
The employer must also address the applicable foreign-worker, wage, and licensing rules. Coordinate the Ministry of Labor work-permit process; do not treat a residence filing as permission to start employment. The ordinary renewal requirements include a valid, notified work permit, updated employment evidence, and a current guarantee.
Personal records
The current checklist asks for a valid passport and legalized copy, applicable background evidence, a certificate of your latest immigration entry, and payment. Additional civil records may be needed. Foreign documents generally need an apostille or legalization and a Spanish translation; check their permitted age before ordering them. You submit the application in person to IGM, Guatemala’s immigration authority.
What This Route Allows
Approval supports residence for the documented employment and approved period. Article 46 requires the migrant worker’s valid work permit to be submitted within three months after notice of residence approval and updated annually. This filing deadline is not authorization to work while permission is pending. Confirm the consequences before changing employer or role.
Family members may apply with the worker using the required relationship and support records. Their own work or other activities must be checked separately. For a stay extending beyond five years, the current regulation points toward a separate permanent-residence application with its own evidence.
What This Route Is Not
It is not an open job-search permit, a residence right created by an unsigned offer, or a substitute for professional recognition. A foreign employer uses the separate foreign-employer route; self-employment has its own tax-registration and business-authorization requirements.
