Summary

Guatemala has a migrant-worker residence category for qualifying employees of foreign employers, rather than a general permission for freelancers. Match the actual employer, payment history, and family circumstances to the current rule.

Certain international NGOs and international organizations use an exception based on employment evidence and medical insurance. Freelancers and self-employed people follow a different category.

The employer category determines the financial evidence
  1. Confirm the foreign employment relationship Check whether the usual foreign-employer rules or an exception for an international organization applies.
  2. Prepare the relevant support records Use payment history or the organization’s required employment and insurance evidence.
  3. Apply with the correct family and labor arrangements Document accompanying dependents and maintain the basis for renewal.

This is not a general freelance or savings route. Foreign employment and the proper evidence remain essential.

Eligibility

Employment by a foreign organization

The arrangement must be employment by a foreign employer. Freelance clients and self-employment should not be presented as employment merely to use this branch; the regulation has separate requirements for people working on their own account.

For remote employees, confirm that the employer permits work from Guatemala and can address the resulting payroll, tax, security, and labor obligations. Immigration approval does not resolve those issues.

The ordinary income evidence or organization exception

For the ordinary branch, provide bank statements showing the required monthly pay from abroad over the last year. An appropriately authenticated or apostilled certification from a public accountant or equivalent professional is an alternative under the regulation. A new contract promising a higher salary does not replace the required history.

If dependents accompany you, use the higher USD $3,000 monthly amount. This is the total household requirement, rather than an extra USD $1,000 for every relative; each dependent still needs their own qualifying application and records.

Where the foreign employer is an international NGO or international organization, the regulation instead requires employment evidence or a contract and medical insurance. That exception does not apply to every foreign private company or every organization describing itself as international.

Application records

The current checklist asks for a valid passport and legalized copy, applicable background evidence, a certificate of your latest immigration entry, and payment. Additional civil records may be needed. Foreign documents generally need an apostille or legalization and a Spanish translation; check their permitted age before ordering them. You submit the application in person to IGM, Guatemala’s immigration authority.

What This Route Allows

Approval permits residence under the foreign-employer worker category for the authorized period. Article 46 also requires migrant workers to submit a valid work permit within three months after notice of residence approval and update it annually. Confirm the labor process for the actual foreign-employer arrangement before starting work; that document deadline does not authorize work while permission is pending. Residence in this branch does not automatically cover an unrelated Guatemalan job or freelance business.

Renewal examines continued qualifying pay or, for the organization exception, continued employment and insurance. The current regulation provides a separate permanent-residence application after five qualifying years; it requires a residence record and further documentation, rather than automatic conversion.

What This Route Is Not

It is not a tourist-work exemption, a general freelancer visa, or a savings-based permission. It is also different from pensioner residence and rentista residence, which require a plan that does not involve paid work.

Next Steps

  1. Confirm the foreign employment relationship and whether the ordinary or organization branch applies.
  2. Assemble the required payment history or qualifying employment-and-insurance records.
  3. Check employer permission, labor requirements, and the correct applications for accompanying family.
  4. File the residence application and maintain the evidence needed for renewal or a later category change.
