Summary

Luxembourg can grant residence for private reasons to a non-EU citizen who does not fit ordinary family reunification but already has unusually strong, stable and long-standing personal or family ties with a person living legally in Luxembourg.

This is an individual, discretionary assessment of established family life. Wanting to live near an adult child, grandchild or other relative is not enough without evidence of the relationship's practical intensity and duration.

Eligibility

The applicant must show stable, long-standing and strong personal or family ties in Luxembourg, such that refusing residence would disproportionately interfere with private or family life. The authorities assess the intensity, duration and stability of the ties in the individual circumstances. If the claimed relationship is an unregistered partnership, neither partner may be married, registered with or in a durable relationship with someone else.

The applicant must also normally show:

All of the applicant's resources can be considered. A Luxembourgish citizen, or a person authorized to reside in Luxembourg for at least one year, may provide the formal financial-support undertaking allowed by the official procedure. That undertaking does not replace proof of the underlying family ties or guarantee approval.

Strong evidence usually covers a substantial period: household registrations, transfers and bills, care or medical records, correspondence, travel, legal responsibilities, statements from relevant professionals and proof that support cannot realistically be provided another way.

What This Route Allows

If approved, the person receives a private-reasons residence permit valid for up to 3 years. It can be renewed while the factual and legal conditions remain met. Guichet.lu lists an €80 residence-permit fee.

The permit is for private residence. A person who wants employment as an ancillary activity may need the separate authorization described by Guichet.lu; someone whose main purpose is work should use the appropriate work route. After 5 years of qualifying lawful residence, EU long-term resident status may be possible under its separate rules.

What This Route Is Not

This is not a broad family visa, a substitute for the ordinary spouse, partner, child or dependent-parent route, or an automatic right under Article 8 of the European Convention on Human Rights. Close affection, frequent visits, planned childcare or a future promise of support may be insufficient.

It is also not Luxembourg's own-resources private route, which is limited to specified professional income or social-security pensions from Luxembourg, the EU or the Schengen area.
