Summary
If your spouse or parent holds an eligible Malaysian Employment Pass, you may be able to join them on a Dependant Pass. This guide covers a legal spouse or child under 18, including an adopted child.
The worker’s employer supports the family application. A Dependant Pass lets you stay with family but does not, by itself, let you take a local job.
Eligibility
Your family member must hold an Employment Pass that allows them to bring dependents. You need accepted proof of marriage or the parent-child relationship, with the required official certification.
Check the rules that apply to their actual pass. The revised framework changes access for Category III families, but an older pass does not automatically gain the newer benefit.
Older children, parents, other relatives, and exceptional dependent-child situations need a separate category check.
-
Check the worker’s actual pass Confirm family eligibility under the policy applying to that pass.
-
Apply with the employer’s support Prepare certified marriage or parent-child records and passports.
-
Check your own stay and work rights After approval, track expiry and arrange separate work permission if needed.
Family residence and permission for local employment are separate.
What This Route Allows
An approved Dependant Pass lets you stay for the family purpose. Its length is limited by the worker’s permission or your passport, whichever allows the shorter period.
If the worker’s pass changes, check whether you need to renew or change your own status. Permanent residence has separate requirements and an application.
What This Route Is Not
You generally need your own Employment Pass to take a local job. Do not assume that the worker’s approval gives the whole family permission to work.
This process differs from the work endorsement available to some foreign spouses of Malaysian citizens.
Next Steps
- Confirm your relationship and the rules applying to your family member’s current Employment Pass.
- Ask their employer to prepare the family application and gather certified relationship and passport records.
- Complete your own pass process. Check work permission separately before accepting employment and track renewal alongside the worker’s pass.
