Summary
Portuguese nationality law includes several important rules for people born in Portugal. A person born in Portugal may already be Portuguese, or may be able to confirm Portuguese nationality, if one of the parent or statelessness rules fits.
The strongest cases are usually birth in Portugal to a Portuguese parent, birth in Portugal before the current nationality law came into force, birth in Portugal to a parent who was also born and resident there, birth in Portugal to a parent who had already legally lived there long enough, or birth in Portugal with no other citizenship available.
Eligibility
You may be a fit if:
- You were born in Portugal.
- You are not already documented as a Portuguese citizen.
- A parent was Portuguese when you were born, or another Portuguese birth rule fits.
- You can document your Portuguese birth and the parent or statelessness facts that matter.
For people born in Portugal to foreign parents, the current law includes rules for a parent who was also born and resident in Portugal, a parent who had legally lived in Portugal for at least five years at the time of birth, and children who would otherwise have no nationality.
What This Route Allows
If the facts fit, this route can lead to recognition or registration of Portuguese nationality. Portuguese citizenship also makes the person an EU citizen, with the free-movement rights that come with EU citizenship.
What This Route Is Not
This is not a broad birth-tourism rule. Being born in Portugal is not always enough by itself under the current law. Parent nationality, parent residence, birth date, and statelessness facts can change the result.
Next Steps
- Get your Portuguese birth record.
- Identify which birth-in-Portugal rule may apply.
- Gather parent citizenship, residence, birth, or statelessness evidence.
- Confirm whether the relevant facts appear on the Portuguese civil record or require a nationality declaration.
- Review the case with Portuguese nationality counsel if the parent facts or birth date are uncertain.
