Guatemala Self-Employed Residence
At a glance
If you plan to work for yourself in Guatemala, you can apply for temporary residence by documenting your activity, expected income, local tax registration, and permission to carry out the work. Registering a company abroad or calling yourself a freelancer does not replace the Guatemalan requirements.
- Who qualifies
- Documented self-employed workers with local registrations
- Documents
- Activity, registration, and qualification records
- Local registrations
- Guatemalan tax registration and authorization for the proposed commercial activity
Summary
Self-employed workers can apply for Guatemalan temporary residence using evidence of their actual activity, projected income, tax registration, and authorization to carry on that activity. This is separate from employment by a foreign company. It is not the foreign-employer branch and does not import that branch’s foreign-salary threshold. Freelancing does not excuse local registration, tax, professional, or work-permission requirements.
-
Describe the work or business precisely Prepare the required notarized statement of activity, location, start, and projected income.
-
Complete tax and activity requirements Document RTU registration and any competent-authority permission.
-
Submit the self-employed residence file Provide the documents required for self-employment; the foreign-employer category has different requirements.
Freelancing does not remove local registration, tax, or professional-authorization requirements.
Eligibility
Your work or business plan
Prepare the notarized statement required by Article 11. It must describe the activity, where you will work, when you will start, and your expected monthly income.
Local registration and permission
Provide Guatemala’s RTU tax registration and the responsible authority’s document allowing the commercial activity. A foreign company registration alone is not enough.
Immigration guarantees and work approval
Confirm which guarantor requirements and Ministry of Labor procedures apply. Applying for residence does not itself authorize work, and the required labor documents also matter at renewal.
Personal documents
Prepare your valid passport, identity and background records with the required authentication, proof of entry, forms, and payments.
What This Route Allows
This allows residence for approved self-employed activity once the immigration application is granted and the separate work requirements are met.
What This Route Is Not
It is not the foreign-employer branch and does not import that branch’s foreign-salary threshold. Freelancing does not excuse local registration, tax, professional, or work-permission requirements.
Next Steps
- Check your proposed activity with the licensing and labor authorities.
- Arrange local tax registration, business permission, and any required guarantee.
- Prepare the notarized activity statement and your personal records, then apply.
- Complete the separate work requirements before starting. If you actually have an employer, compare local employment or foreign employment.
